How Does Mediation Affect Court Proceedings?

You leave mediation with an agreement on the house and retirement accounts, but no agreement on maintenance. The next job is to separate what you settled from what still needs a judge. A partial settlement can shorten a divorce trial, but only if the agreement is recorded clearly and the remaining court deadlines are handled. The Law Office of Chad Foster helps Snohomish County families with family-law mediation.

What happens after a mediation session
Agreement
Record the actual terms
Clear, properly documented assent matters for enforceability.
Court orders
Submit the necessary papers
A settlement does not automatically become a signed decree or parenting order.
Unresolved issues
Keep the case moving
Deadlines and hearings remain unless the court changes them.
Use these checkpoints with the details and exceptions explained below.

Make a Clear Record of the Settled Issues

Before the session ends, identify the precise issues resolved, the terms agreed to, and anything left open. A proposal discussed in a private meeting is different from a completed agreement. Do not assume that a mediator's notes or an informal summary have the same effect as a signed settlement.

Washington's CR 2A addresses disputed agreements concerning proceedings. A disputed agreement ordinarily needs the record or writing the rule describes, such as an agreement made and recorded in open court or written evidence subscribed by the attorney denying it. Whether a particular signed mediation document is binding can also involve ordinary contract principles. Have counsel confirm that the form of your agreement supports enforcement before relying on it to cancel preparation for trial. If compliance becomes disputed, examine how a mediation agreement can be enforced.

Convert the Agreement Into the Orders You Need

A signed settlement does not, by itself, replace every existing order or end the marriage. Someone still needs to draft and present the appropriate agreed orders. Check that the language in the proposed order matches the agreement, especially deadlines to refinance, transfer accounts, pay equalizing amounts, or exchange property.

RCW 26.09.070 distinguishes property and maintenance terms in a separation contract from provisions affecting children. The court retains responsibility for child support, parenting arrangements, and the children's best interests. Parents cannot remove that review by labeling a term settled. A dissolution decree also remains subject to RCW 26.09.030's waiting period and other requirements.

For a partial settlement, identify which terms can be entered now, which belong in final orders, and whether any obligations depend on resolution of the remaining issues. Do not assume an interim agreement automatically changes an existing temporary order. Until an order is changed, follow its terms.

Prepare the Remaining Issues for the Judge

Make two lists: the issues the written agreement resolves, and the issues the court must still decide. If maintenance remains disputed, preparation should address the evidence relevant to maintenance rather than relitigating an agreed asset division. If a property term is conditional on another issue, identify that dependency rather than presenting an incomplete deal as final.

Keep discovery, exhibit, witness, and trial-confirmation deadlines on the calendar unless the court changes them. A mediation session does not automatically continue a hearing or stop the case schedule. Ask for an agreed scheduling change or a court order when needed, and confirm which dates actually changed.

Keep Settlement Talks Separate From Trial Evidence

RCW 7.07.030 generally protects mediation communications from discovery and admission, subject to waiver and statutory exceptions. The signed agreement is different: RCW 7.07.050 includes an exception for an agreement evidenced by a record signed by all parties to it.

That distinction gives you a practical filing rule. Use the properly documented agreement to establish the settled terms. Use independently admissible evidence to prove the disputed issues. Do not attach negotiation messages or repeat a mediator's assessment merely to show that the other side was unreasonable. Evidence that was already discoverable does not become privileged simply because someone brought it to mediation.

A Practical Post-Mediation Checklist

Confirm who will draft each order, who will review it, and when it will be presented. List every obligation that starts before the final decree. Confirm whether the trial will go forward on fewer issues or whether a court-approved schedule change is needed. Keep a copy of the executed agreement and distinguish it from unsigned drafts.

The useful outcome of a partial settlement is a smaller, clearer case.
